Our research team is delighted to announce the publication of our book “Diversity and European Human Rights: rewriting judgments of the ECHR” edited by prof. dr. Eva Brems and published by Cambridge University Press. This book is the fruit of the conference “Mainstreaming Diversity: Rewriting Judgments of the European Court of Human Rights” that we organized in the premises of the Strasbourg Court in February 2011.
The edited volume contains contributions by leading scholars in the field of human rights law. Moreover, it is the perfect opportunity to acquaint yourself with the scholarly work of Strasbourg Observers Alexandra Timmer, Lourdes Peroni, Saïla Ouald Chaib and Maris Burbergs.
In this book, the authors suggest ways in which the European Court of Human Rights can better mainstream diversity in the adjudication of cases concerning women, sexual minorities, people with disabilities, children and ethnic and religious minorities. They do not only offer a critique of the court’s judgments – something academics usually do, but the contributors go a step further and rewrite judgments as if they were judges.
Thus, eighteen judgments are considered and rewritten. Each redrafted judgment is accompanied by a paper in which the authors discuss the theoretical concepts and frameworks that guided their approaches and in which they explain why the rewritten judgments would be an improvement. Thereby the authors demonstrate how ideas can be translated into judicial language, but also how difficult such translation can be. By rewriting actual judicial decisions on a wide range of topics this book offers a broad overview of diversity issues in the jurisprudence of the ECHR and aims to bridge the gap between academic analysis and judicial practice.
